DOJ Lawyers Confirm Trump Admin Targeted Blue States for Political Reasons

Trump's Energy Policy and Partisan Grants

President Donald Trump and his allies within the Make America Great Again (MAGA) movement have consistently criticized the use of green energy, targeting both Democratic-controlled states in the United States and countries in the European Union (EU). Trump has argued that EU nations should increase their reliance on fossil fuels. This stance was evident during a meeting with UK Prime Minister Keir Starmer, where he criticized the UK for its use of wind energy, even though the UK had already left the EU.

Part of the Trump administration's energy strategy involved distributing energy grants to individual U.S. states. However, a recent court filing by government lawyers revealed that the decision to cut these grants was influenced by political considerations. The Washington Post reported that the administration admitted the cuts were based on whether the states tended to elect Democrats at the state or national level.

Court Filing Reveals Partisan Influence

In an article published on December 17, Meryl Kornfield and Hannah Natanson from the Washington Post explained that the Trump administration acknowledged in a court filing that the decision to cut energy grants during the government shutdown was influenced by partisan factors. The filing stated that "consideration of partisan politics is constitutionally permissible, including because it can serve as a proxy for legitimate policy considerations."

This admission, described as "remarkably candid" by the reporters, echoes Trump's frequent promises to punish cities and states he views as adversaries. Examples include withholding disaster relief for Southern California and deploying National Guard troops to "blue" cities. The admission could also open the door for federal attorneys to use similar arguments in legal challenges against other unilateral cuts made by the Trump administration targeting blue states and cities.

Legal Challenges and Concerns

A coalition of Minnesota clean energy groups and the city of St. Paul filed a lawsuit against the Trump administration last month in the U.S. District Court for the District of Columbia. The lawsuit followed the Energy Department's announcement of slashing 321 grants worth approximately $7.5 billion. These cuts included projects aimed at kick-starting the hydrogen industry in California, upgrading the electricity grid serving Indigenous communities in New Mexico, and generating new energy mostly from wind and solar in Minnesota.

At the time, Russell Vought, Trump’s budget director, highlighted the cuts on X, declaring "nearly $8 billion in Green New Scam funding to fuel the Left's climate agenda is being canceled" and listing blue states as beneficiaries of the funds.

Expert Reactions

Legal experts interviewed by the Washington Post expressed concerns about the implications of the Trump administration's actions. Dan Farber, a law professor at the University of California, Berkeley, told the Post, "It really undermines the idea that you're passing neutral laws that you know are supposed to apply equally to everybody. I find it really startling they would make that concession."

David Super, a law professor at Georgetown University in Washington, DC, added, "I cannot believe that the Supreme Court would want to allow a partisan tit-for-tat to develop with each party pulling grants from its perceived partisan foes, but one can never be entirely certain these days."

Ongoing Implications

The revelations about the Trump administration's energy grants highlight the potential for political bias in federal funding decisions. As the legal battles continue, the broader implications for future policies and the balance of power between federal and state governments remain uncertain. The situation underscores the importance of maintaining neutrality in public policy and the risks of allowing partisan interests to influence critical areas such as energy and infrastructure.
