The Controversial Claims of Mat Staver and the Mischaracterization of Obergefell v. Hodges
Mat Staver, founder and chairperson of Liberty Counsel, a legal advocacy group with strong anti-LGBTQ+ Christian nationalist views, recently made headlines for an email he sent on September 16 that blamed the murder of Charlie Kirk on the Supreme Court’s 2015 decision in Obergefell v. Hodges. This ruling legalized same-sex marriage across the United States, but Staver mischaracterized the decision as promoting the "abolition of gender."
In his email, Staver claimed that the killer of Charlie Kirk and their partner were products of Obergefell, suggesting that the decision led to the erosion of traditional gender roles. However, this is a complete misrepresentation of what the Supreme Court actually ruled. The decision affirmed that same-sex couples have the fundamental right to marry, based on the Equal Protection Clause of the Constitution. It did not advocate for the elimination of gender or any other concept.
Staver also attempted to link the suspect in Kirk’s murder, Tyler Robinson, to the furry subculture, citing a possible connection to FurAffinity.net, a website where users may express themselves through animal personas. He further claimed that furries fall under the broader "xenogender" umbrella, which is a nonbinary identity where individuals identify with animals, plants, or objects rather than traditional gender categories. While xenogender exists within the LGBTQ+ community, it is a very small subset, and most members of the community are unfamiliar with the term.
Additionally, Staver referenced Kim Davis, a former Kentucky county clerk who refused to issue same-sex marriage licenses. He suggested that her experiences, including harassment by two men in court, were part of a larger pattern of resistance against the "genderless lie." Liberty Counsel is supporting Davis’ efforts to overturn Obergefell, though these efforts are widely considered unlikely to succeed.
However, Staver’s claims about the motives behind Kirk’s murder are speculative at best. The Utah attorney general has stated that they will not speculate on the killer's motivations, emphasizing the need for factual evidence rather than conjecture.
Staver’s comments also reveal a deep misunderstanding of same-sex relationships. He suggested that in lesbian relationships, one woman assumes a masculine role, and in male-male relationships, one man takes on a feminine role. This is a reductive and inaccurate portrayal of how many LGBTQ+ individuals experience and express their relationships. Many same-sex couples do not conform to traditional gender roles, instead focusing on emotional and personal connections rather than gender expression.
Furthermore, Staver falsely claimed that Obergefell led to an increase in the number of Americans identifying as transgender. He then accused the LGBTQ+ community and the "radical left" of promoting a "sexual revolution" that includes "all forms of deviancy," such as pedophilia and bestiality. These assertions are not supported by any credible evidence.
He also echoed transphobic rhetoric by claiming that high doses of cross-sex hormones cause emotional instability, despite the lack of scientific support for this claim. In reality, gender-affirming care has been shown to significantly improve mental health outcomes for transgender individuals.
Staver concluded his email with a plea for donations, asking readers for $50. His message, filled with misinformation and fearmongering, highlights the ongoing challenges faced by the LGBTQ+ community in the face of extremist rhetoric.
The claims made by Staver and groups like Liberty Counsel continue to fuel division and misinformation, often at the expense of accurate understanding and empathy. As the conversation around LGBTQ+ rights and gender identity evolves, it is crucial to rely on facts, education, and compassion rather than fear-based narratives.
