The Struggle for Control of the U.S. Attorney’s Office in New Jersey

The ongoing battle over who leads the U.S. Attorney’s Office in New Jersey highlights a deepening conflict between the Trump administration and federal judges. This situation has raised serious concerns about the rule of law, the independence of the judiciary, and the integrity of the legal system.

Alina Habba, a close associate of former President Donald Trump, was appointed as the interim U.S. attorney in March. Her 120-day term is set to expire soon, and although she has been nominated by the president for confirmation by the U.S. Senate, her nomination is still pending. Federal law allows the state’s federal judges to appoint a replacement until the Senate confirms the nominee. On Tuesday, the judges selected Desiree Leigh Grace, Habba’s deputy, to take over the position.

The reasons behind the judges’ decision to reject Habba remain unclear. However, there are several troubling aspects of her tenure that have drawn criticism:

• Public Support for Andrew Tate: Habba made controversial public statements supporting Andrew Tate, an alleged sex trafficker, in January.
• Political Agenda: She openly pledged to use her position as prosecutor to support Republican candidates in New Jersey.
• Partisan Prosecution: Habba initiated a case against Newark Mayor Ras Baraka, which was widely seen as politically motivated. The case was dropped just days later.
• Investigation into Governor and Attorney General: She announced an investigation into New Jersey’s governor and attorney general on Fox News, a move that appeared more aimed at gaining media attention than pursuing justice.
• Subpoena of Governor Murphy: She subpoenaed Governor Phil Murphy over comments he made in February about potentially hiding an undocumented immigrant at his home. These comments were not criminal in nature.

Despite these issues, the federal judges acted within their legal authority to select a replacement. The Trump administration, however, has taken a different stance, accusing the judges of political bias and colluding with Democrats.

Attorney General Pamela Bondi and her deputy, Todd Blanche, have criticized the judges, claiming that the decision was not based on legal grounds but rather on political motives. Bondi stated, “This Department of Justice does not tolerate rogue judges — especially when they threaten the President’s core Article II powers.” Blanche added, “The district judges in NJ just proved this was never about law — it was about politics.”

These claims are not only misleading but also dangerous. They ignore the clear legal framework that grants federal judges the power to appoint a U.S. attorney when the president’s nominee is not confirmed. Instead, the administration is attempting to manipulate public perception by framing the judges as adversaries.

There are growing concerns about how this conflict will resolve. Grace, who has been chosen to take over, has stated her intention to assume the role on Saturday. It is unlikely that this decision will be welcomed by all members of the Trump administration.

In New York, a similar situation has unfolded. John Sarcone, Trump’s pick for U.S. attorney in the northern district, was not chosen to remain in the position by the local judges. Instead, the president gave him a different title, allowing him to continue serving as the acting U.S. attorney. This pattern suggests that the administration may find ways to maintain control despite judicial decisions.

The outcome of this conflict could have significant implications for the functioning of the government. If the Trump administration continues to prioritize personal loyalty over legal and ethical standards, it risks undermining public trust in the justice system.

As the situation unfolds, it remains to be seen how the legal and political landscape in New Jersey will respond. For now, the struggle over the U.S. Attorney’s Office serves as a stark reminder of the challenges facing the American legal system.
