Trump's Push to Eliminate the Blue Slip Tradition
President Donald Trump has recently taken a strong stance on changing the long-standing tradition of "blue slips" within the Senate Judiciary Committee. This system allows senators from states where a presidential appointee is being considered for a federal judgeship or U.S. attorney’s office to effectively veto the nomination by not submitting their blue slips in agreement.
Trump has directed his attention towards Senator Chuck Grassley, the Republican chair of the Senate Judiciary Committee, urging him to eliminate this practice. The goal, according to Trump, is to make it easier for him to appoint far-right prosecutors in Democratic-controlled states.
What Are Blue Slips?
Blue slips are a longstanding tradition that gives senators from the same state as a nominee the power to block their confirmation. This process is particularly significant when considering federal judgeships and U.S. attorney positions. For instance, Senators Cory Booker and Andy Kim from New Jersey did not submit blue slips in favor of Alina Habba, a controversial acting U.S. attorney for the District of New Jersey. In a recent post on Truth Social, Trump criticized the blue slip system, accusing Democrats of using an “ancient, and probably Unconstitutional, ‘CUSTOM’” to prevent the appointment of Republican candidates. He claimed that this system was designed to stop the opposite party from nominating anyone, even if they were great candidates.

Trump argued that the only way to overcome this perceived “hoax” is to appoint a Democrat or a weak and ineffective Republican. He pointed out that he would never be able to appoint great judges or U.S. attorneys in states like California, New York, New Jersey, Illinois, and Virginia, which he claims have the highest levels of crime and corruption. These are the areas where he believes fantastic people are most needed.
He urged Grassley to take action, saying, “Chuck, I know you have the Courage to do this, DO IT!”

Democrats have followed the blue slip system even when it worked against them. In 2023, President Joe Biden withdrew the nomination of Scott Colom for a U.S. District Judge position in Mississippi. Senator Cindy Hyde-Smith, a Republican, refused to return a blue slip for Colom's confirmation, and then-Senate Judiciary Committee chairman Dick Durbin (D-Ill.) did not abolish the blue slip system to confirm Colom.
