Trump Administration Extends Tenure of U.S. Attorney in California

The Trump administration has taken steps to extend the tenure of Bill Essayli as the top federal prosecutor in the Central District of California. This move comes after his initial 120-day interim appointment expired, allowing him to assume an acting role without Senate confirmation. Essayli, a former Republican state legislator and long-time ally of President Donald Trump, was first appointed to the position in April by then-Attorney General Pam Bondi. However, his term was set to end on Wednesday unless a formal nomination was sent to the Senate.

According to two Justice Department officials, Essayli is expected to take on the acting role at 5:01 p.m., granting him up to 210 additional days in office. This decision aligns with similar actions taken by the Trump administration in other states, including New Jersey, New York, Nevada, and Washington, D.C. In those cases, court-appointed successors were bypassed or removed to maintain control over key legal positions, often amid partisan disputes over confirmations.

This latest move reflects a broader effort by the administration to retain legal leadership in the face of Senate gridlock. The issue has become particularly contentious in New Jersey, where the interim term of Trump’s nominee, Alina Habba, expired. A federal judicial panel had selected her deputy, Desiree Grace, as a replacement. However, Bondi rejected this choice, removed Grace from the department, and reappointed Habba in an acting capacity.

Legal challenges have followed, with criminal defense attorneys arguing that Habba lacks the authority to prosecute cases. At least two criminal cases in New Jersey have been delayed due to questions about her leadership. The Justice Department defended the decision, stating in a court filing that “Ms. Habba is validly serving as the acting United States Attorney.” However, U.S. District Judge Edward Kiel called the issue a “non-frivolous argument” and warned that further delays could occur across the district. An appellate judge later transferred one case to Pennsylvania to avoid disruption.

Supporters of the president argue that the handling of U.S. attorney appointments is a response to the dysfunction in the Senate, where delays have become common, especially for Justice Department roles. Senator Dick Durbin (D-IL), a ranking member of the Senate Judiciary Committee, has criticized the situation, calling for the White House to honor the blue slip rule, which involves consultation with U.S. senators from the relevant states.

Legal experts note that the White House is leveraging a gray area in federal law that allows for acting appointments once interim terms expire and judicial panels fail to act. Carl Tobias, a professor at the University of Richmond School of Law, stated that the administration is effectively avoiding Senate advice and consent by using acting and interim positions. He noted that there are currently over 90 such appointments, none of which have been confirmed.

While federal judges serve for life, U.S. attorneys typically hold four-year terms. The Senate confirmation process faced challenges after former Senator Harry Reid broke tradition to expedite the confirmation of President Barack Obama's appointees. Tobias emphasized that the stakes are higher for judges due to their lifetime tenure compared to U.S. attorneys, who serve shorter terms. He added that if the Senate functioned regularly, as it did during Trump’s first term when 85% of his nominees were confirmed, these issues would not arise.

Controversy Surrounding Essayli’s Leadership

In Los Angeles, Essayli’s leadership has sparked debate. He has frequently clashed with Governor Gavin Newsom (D), echoing Trump's criticisms of the governor's handling of the state's annual wildfire disasters. A recent investigative report by the Los Angeles Times highlighted challenges he faced in proving allegations in several cases involving anti-immigration enforcement rioters during recent protests.

Despite the controversies, Essayli has maintained that a strong stance is necessary to address the needs of law enforcement in Los Angeles. In a recent interview with a local Fox News affiliate, he argued that federal law enforcement intervention was crucial to assist local sheriffs during periods of unrest in the city.
