A Family's Fight for Accountability After a Child's iPad Was Stolen and Misused
A family from Berkeley County is seeking justice after their child’s iPad was stolen and used in a disturbing manner. The incident has led to a lawsuit against Delta Air Lines and Unifi Aviation, a ground handling and aviation services company. The family claims that an employee of one of these companies stole the device and used it for inappropriate purposes.
The legal action was initiated by Motley Rice LLC on July 16, though the iPad was lost during a flight from Charleston to New York City in July 2023. Attorneys for the family have stated that they waited as long as possible, hoping that Delta would take responsibility, but no resolution was reached.
Tory and Brooke Brewer are filing the lawsuit against both Delta and Unifi Aviation. They are seeking compensation for negligence, emotional distress, intentional infliction of emotional distress, sexual assault, and harassment. According to Tola Familoni, one of the attorneys involved, the situation has caused significant trauma for the Brewer family.
“Putting it simply, this is a traumatic event to occur,” Familoni said in an interview with News 4. He explained that the iPad was left behind on the plane and later allegedly stolen by a Delta and Unifi employee. The device was then used to take and send pornographic images and videos, prompting the legal action.
Familoni emphasized that the family reported the loss to Delta the day after the iPad was left on the plane but received no response. More than a month later, lewd videos and pictures began appearing through the family’s shared iCloud account. Over time, more material surfaced, according to the lawsuit.
In addition, the family claims that their iTunes and Amazon accounts were hacked. “The Brewers had filed more than one loss report with Delta notifying them of what had occurred on top of this phone call that they ultimately had to make to get some type of end result and still nothing,” Familoni said.
To date, the family has not received any form of apology or communication from Delta. The videos in question, taken on one of the Brewers’ minor children’s devices, show a man wearing a Delta badge while engaging in sexual conduct.
“The iPad was covered in a very vivid pink Peppa the Pig cover,” Familoni explained. “Peppa the Pig is a children's animated TV show. It's very clearly for children, not an adult device.”
Delta has responded by stating that the individual in the photos is not a Delta employee but someone from a vendor company. The airline declined to comment further, citing a zero-tolerance policy for unlawful behavior.
“The individual in the photos is wearing a Delta name badge and a Delta uniform. So, for them to deflect and act as if they don't have any responsibility here, it's tragic,” Familoni said.
Unifi Aviation, which was formerly partly-controlled by Delta Air Lines, is also named in the lawsuit. The aviation services company is a well-known global provider.
The Brewers are now calling for changes to prevent similar incidents from happening to other families. “Enact measures to ensure that safeguards are in place where lost devices or belongings are left behind on a plane. That they secure them immediately and prevent anybody from accessing them in any shape or form,” Familoni explained.
As of now, Delta and Unifi have not been served with the lawsuit. Once they are, the attorneys said both companies will have 21 days to respond.
