Enhancing Consumer Protection: San Diego County District Attorney’s Office Expands Reporting Options

The San Diego County District Attorney’s Office is taking significant steps to improve consumer protection by simplifying the process of reporting fraud. One of the key initiatives involves making it easier for individuals to file complaints online, which includes uploading supporting documents directly through the office’s website.

These updates come as part of a broader effort to address consumer issues and hold corporations accountable. Recently, the office announced that it helped secure over $13.6 million in stipulated judgments across three major cases. This includes a $7.5 million settlement with HelloFresh, a meal-kit delivery company, which was one of several cases involving automatic subscription renewals without proper disclosure.

Streamlined Complaint Process

Previously, consumers had to download forms, print them out, and mail them in. Now, the updated website allows users to submit reports and attachments electronically. This change aims to make the process more accessible and efficient for those seeking to report fraudulent or deceptive practices.

Over the past few years, the office has received approximately 200 complaints per month. Each complaint is reviewed and vetted, with some being escalated for further investigation. Prosecutors typically focus on behaviors that could affect a large number of consumers, ensuring that actions taken are impactful and meaningful.

Notable Settlements and Legal Actions

In the case involving HelloFresh, San Diego County was among a small group of prosecutors’ offices that filed a lawsuit against the company. The case was filed in Santa Clara County, and the settlement was recently approved. San Diego’s share of the settlement is just over $1 million.

District Attorney Summer Stephan emphasized the importance of these civil actions, stating that they protect consumers and ensure companies follow the laws designed to provide accurate pricing information and prevent misleading practices such as hidden automatic renewals.

The settlement also includes $1 million in restitution for eligible California consumers who were enrolled in HelloFresh's automatic renewal program between 2019 and last Friday. These consumers will be notified about the restitution, according to the Santa Clara District Attorney’s Office.

HelloFresh responded to the settlement by stating that it prioritizes customer transparency and that its subscription model and cancellation policies have been clear throughout the customer journey. While the company denies any wrongdoing, it acknowledges cooperation with the coalition of California District Attorneys and the decision to settle the matter amicably.

Additional Settlements and Collaborative Efforts

In another case, the San Diego County District Attorney’s Office collaborated with other agencies to secure a $5.6 million settlement with Walmart. The lawsuit alleged that the retailer charged customers more than its lowest advertised price. San Diego’s portion of this settlement is about $1.375 million.

Additionally, a lawsuit against a local jeweler, Attractive Gems, resulted in a $500,000 settlement last month. The state Attorney General’s Office cited deceptive lending practices as the reason for the settlement. However, the company’s attorney was unavailable for comment at the time.

Use of Settlement Funds

The money received from these settlements is designated for enforcing consumer protection laws. This ensures that the funds are used effectively to support ongoing efforts to safeguard consumers from fraudulent activities.

Staff members are available on Thursdays at the District Attorney’s CARE Center located at 12 North Euclid Avenue in National City. They are also present at One Safe Place: the North County Family Justice Center, located at 1050 Los Vallecitos Boulevard in San Marcos.
