A Student's Disturbing Experience with Unauthorized Subletting

A University of Pittsburgh student recently shared a harrowing experience that unfolded when he returned to his Oakland apartment after being away for part of the summer. Maverick Crupi, a sophomore at Pitt, discovered that two strangers had moved into his apartment while he was away. The situation quickly turned chaotic, leading to an intense and unsettling encounter.

Crupi learned that his former roommate had sublet the entire apartment to a couple in May without his knowledge. He clarified that the lease he signed was not a "by the bed" lease but rather one that covered the entire unit, which he shared with a roommate. This misunderstanding led to a significant conflict when he arrived at the apartment and found a couple living there.

Upon entering, Crupi encountered a woman who was naked and clearly frightened, as well as her boyfriend, who was also visibly upset. The situation escalated quickly, with the boyfriend yelling and expressing his confusion. Despite the initial tension, Crupi emphasized that he did not blame the couple for what happened. He believed the responsibility lay solely with SkyVue, the property management company.

After several weeks of back-and-forth communication, Crupi managed to have the July rent waived. However, he is still responsible for paying the utilities and the first two months of rent when the couple was living in the apartment. He believes this situation constitutes a violation of his lease agreement.

In the subletting clause of his lease document, it states that if a replacement resident is approved, they must either sign the existing lease contract or both the original and replacement residents must sign a new lease. Crupi argued that this process was not followed in his case, highlighting the importance of adhering to the terms of the lease.

An attorney specializing in tenant/landlord issues, Marc Taiani, advised that all parties involved in a sublease should agree in writing. This ensures clarity and protects the rights of both tenants and landlords.

SkyVue responded to the incident with a statement, explaining that they operate under a by-the-bed leasing model, where residents rent a specific bedspace within an apartment. They claimed that the replacement resident met the requirements outlined in the lease’s Procedures for Replacement clause. While they stated compliance with the lease agreement, they acknowledged the need for better communication with affected residents and are working towards a resolution.

This incident has sparked discussions about the importance of clear communication between tenants, roommates, and property management companies. It also underscores the necessity of following lease agreements to prevent such conflicts from arising.
