A Man's Journey to Freedom After a Detention and Legal Struggle

A man who was detained during the Glenn Valley Foods raid has finally been released on bond from the Lincoln County Detention Facility. His release came after a series of advocacy efforts and legal actions taken by various organizations. The process was not straightforward, but ultimately, the man was able to reunite with his partner and two children.

The story began when KETV Investigates uncovered a leaked Department of Homeland Security directive that tightened eligibility for detainees to be released on bond. This development raised concerns among advocates and legal professionals who were already working to secure the man’s release.

The detainee, whose name is being withheld for confidentiality, was reunited with his family on Monday. Several advocacy organizations, including the American Civil Liberties Union (ACLU), Prairielands Freedom Fund, HOPE-Esperanza, and others, played a crucial role in this outcome. Their persistent efforts helped bring attention to the case and push for a fair resolution.

Mindy Rush Chipman, executive director of the ACLU, shared her thoughts on the situation. “The family was just wrapped in support,” she said. The man had faced removal proceedings, and his eligibility for bond was determined by an immigration judge on July 9. His attorney successfully argued that he was not a flight risk and not a danger to the community.

Following the ruling, the man was granted a $10,000 bond, which was paid the next day with assistance from the Prairielands Freedom Fund. Elizabeth Bernal of the fund explained the challenges involved in raising the money. “It’s not easy to get the money together,” she said. “Some people have to be really going on the salary that they have, borrow money, or sell their own stuff.”

Despite paying the bond, the man’s family initially faced setbacks trying to secure his release. After a four-hour drive to the detention center in North Platte, they were informed he would not be released. They returned the next day, only to face the same news again.

The ACLU and other advocacy groups stepped in, assisting the attorney by contacting U.S. Immigration and Customs Enforcement (ICE). They emphasized that the detainee had complied with all requirements. “Our client had done everything that he was supposed to do, and there was an immigration court order that needed to be followed,” Chipman said. This ultimately led to the man’s release.

“He was able to be reunited with his family,” Chipman said. However, she noted that his coworkers at the Lincoln County Detention Center have not had the same opportunity. Legal proceedings for the detainee are far from over. According to Chipman, his next hearing is set for April 2026. “That’s not the trial. That is just what we would call like a preliminary hearing,” she said.

Reflecting on the situation, the detainee’s attorney, Paul Forney, expressed his frustration. “In this case, ICE has demonstrated a blatant disregard for the rules, regulations and my client’s civil liberties.” KETV reached out to ICE for a statement on the detainee’s release but has not received a response.

The case highlights the complexities of the immigration system and the importance of advocacy in ensuring that individuals receive fair treatment. It also underscores the need for continued efforts to support those facing removal proceedings and to hold authorities accountable for their actions.
