Legal Battle at Netflix: A Former Employee Accuses Executives of Discrimination and Retaliation

A former labor relations lawyer at Netflix has filed a lawsuit against the streaming giant and two of its executives, alleging that she and other employees faced discrimination and retaliation. The case highlights concerns about a hostile work environment and potential violations of workplace rights.

Nhu-Y Phan, who worked at Netflix from May 2021 until her termination in September 2024, claims that she and other women of color experienced gender and racial discrimination under senior labor relations lawyer Ted Sinclair and Director of Labor Relations Jonah Cozien. According to the lawsuit, Phan and her colleagues were consistently passed over for opportunities they were qualified for and excluded from key meetings.

Phan, an Asian American woman, alleges that she and other female employees of color faced systemic bias within the company. She claims that after filing complaints about discrimination and harassment, she was subjected to retaliatory actions by Sinclair and Cozien, which ultimately led to her wrongful termination.

The lawsuit states that Phan was well-paid and received positive performance reviews during her early months at Netflix. She even received a $50,000 raise and was considered the go-to person for labor-related advice. However, her treatment changed significantly after she raised concerns about her supervisors.

Exclusion and Hostile Work Environment

According to the complaint, Sinclair began excluding Phan and other women of color from professional opportunities and assigning them to less qualified white employees. At one point, Phan was left out of negotiations between Netflix and the Directors Guild of America (DGA), despite having previously worked with multiple executives at the DGA.

Phan reported at least eight verbal or written complaints about Sinclair’s behavior. Eventually, she moved under Cozien’s supervision. However, she later alleged that Cozien sexually harassed a female colleague, prompting her to report the incident. The colleague reportedly felt uncomfortable due to Cozien’s persistent requests for lunch, dinner, and after-work drinks, even outside of regular hours.

Following this, Phan claims that Cozien became hostile toward her and revoked opportunities. The lawsuit further alleges that Cozien conspired with Sinclair to have her fired by writing a critical performance review.

Legal Action and Company Response

Phan is seeking a jury trial and unspecified damages from Netflix, Sinclair, Cozien, and other unnamed employees. Her attorneys argue that the company failed to address the issues and instead retaliated against her for speaking out.

Brian Olney, an attorney representing Phan, described Netflix as a “corporate bully” that avoids responsibility for its actions. He emphasized that Phan had the courage to expose discriminatory practices and sexual harassment within the company.

Netflix has responded to the allegations by stating that the claims lack merit and that the company will defend itself vigorously in court. The company has not yet commented on the specific accusations made in the lawsuit.

The lawsuit highlights the emotional and financial toll on Phan. Her attorneys stated that she has faced significant challenges in finding comparable employment and has suffered from stress, humiliation, and damage to her professional reputation.
