A judge in West Palm Beach has sentenced Damian Conti to 35 years in prison for sexually abusing a student. This decision came after rejecting his plea for leniency, which he claimed was due to his "childlike" disposition and remorse. Circuit Judge Howard Coates expressed skepticism about the sincerity of Conti’s remorse during the sentencing hearing on July 29, stating, “I certainly believe he's sorry that he was caught.”

Conti, who was convicted in June of four counts of unlawful sex with a student, faced a maximum sentence of 120 years. However, he requested only five years, while prosecutors recommended 50 years. Assistant State Attorney Alexa Ruggiero emphasized that the abuse was not a momentary lapse of judgment but rather a calculated act. She stated, “This took precision.”

The sentencing hearing was marked by emotional outbursts from Conti, accusations of perjury from prosecutors, and a lengthy statement from the student he victimized throughout the 2023-24 school year at SouthTech Academy in Boynton Beach.

The student, now 18, addressed Conti directly but kept her back to him as instructed by the judge. She described how she relives the trauma of the abuse in her sleep, experiencing anxiety, heart racing, and drenched in sweat. Unlike her testimony in June, where she detailed the sexual transgressions, this time she focused on the psychological toll of the abuse and her slow realization that what happened was indeed abuse.

She was 16 when the abuse began. Now, she is dressed in all black, having chosen a university far from Palm Beach County. Despite the distance, she still feels as though her abuser is close by. Her life has been drastically altered, and she no longer sees herself as the smiling, outgoing girl she once was.

Defense Testimonies and Their Credibility

Assistant Public Defender Lily Boehmer called upon Conti’s relatives and a longtime friend to challenge his portrayal as a predator. They described him instead as a devoted father who made a catastrophic mistake while dealing with marital problems and the death of his mother. Ronald Conti, his uncle, insisted, “He is a normal person who made a mistake, giving into temptation.” He also mentioned that Conti’s incarceration had opened his eyes to the error of his ways.

David Conti, another relative, described his cousin as a “puppy dog” who was cheerful, eager to please, and emotionally dependent on others. He argued that Conti was not violent or evil but had made a wrong decision. However, these claims were undermined by recordings of conversations between Conti and his cousin, which prosecutors reviewed. These recordings revealed that Conti often disparaged the victim and questioned the legal standards of consent in Florida.

During cross-examination, David Conti was accused of lying under oath. The prosecutor asked, “You would agree that when you weren't talking about the law of consent and how ridiculous that is, you were disparaging Judge Coates himself?” David Conti denied these allegations, calling them “absolutely insane.”

Legal and Ethical Considerations

Boehmer submitted a letter written in support of Conti, but its author was recently indicted on capital sexual battery charges involving a 5-year-old. The defense did not read the letter aloud but played a snippet of the teen’s deposition, where she said, “Conti said he wanted to wait to have sexual relations until you were 18?” The teen confirmed this.

Under Florida law, the age of consent is 18, and those aged 16 and 17 can legally consent only to a partner younger than 24. Despite this, Boehmer asked Coates to consider a downward departure based on the student being a willing participant. However, Coates expressed concerns about whether a 16-year-old in a student-teacher relationship could truly engage in a consensual relationship. He ultimately decided not to pursue the downward departure.

Judge Coates concluded the hearing by expressing hope for both Conti and the victim. He told the student, “You were put in a position that no 16-year-old should ever have to be put in. I hope that you will be able to overcome it, and I have some confidence that you will.”
