Diddy's New Bail Request and Legal Battle

Sean "Diddy" Combs is seeking release on a $50 million bond while awaiting sentencing for two prostitution convictions, each carrying up to 10 years in prison. Despite being acquitted of more serious charges like sex trafficking and racketeering, prosecutors claim he led a violent criminal enterprise. His legal team argues the charges stem from consensual relationships and has proposed bond terms including surrendering his passport and limiting travel.

Judge Arun Subramanian previously denied a bail request, citing concerns about potential violence linked to Diddy’s past. Now, Diddy’s legal team is pushing for his release on a $50 million bond while he awaits sentencing, which is set for October 3.

Mixed Verdict and Legal Arguments

On July 2, Diddy was cleared of the more serious charges of sex trafficking and racketeering conspiracy. However, he was found guilty on two counts of transportation to engage in prostitution under the Mann Act. The mixed verdict was seen as a win for the rapper, prompting his legal team to request bail. Judge Subramanian swiftly rejected the initial request.

Under the Mann Act, those convicted are generally held in custody unless they can demonstrate exceptional circumstances and prove they are neither a flight risk nor a danger to the community. Diddy’s defense team is now arguing that his situation presents "exceptional circumstances warranting a departure from mandatory detention."

Defense Claims and Historical Context

The defense reiterated points made during the trial, claiming that both Casandra "Cassie" Ventura and another ex-girlfriend, who testified under the alias "Jane," were involved in a consensual swingers lifestyle, not victims of coercion as prosecutors alleged. They also argue that the Mann Act has never been used in a case with similar facts.

"In the history of the statute, the Mann Act has never been applied to facts similar to these to prosecute or incarcerate any other person," the defense motion stated. They further argued that over the past 75 years, the law has only been applied in cases involving "interstate travel for financial gain through the business of prostitution," not personal relationships.

Judge Concerns About Past Violence

In their previous motion in early July, Diddy’s legal team proposed a $1 million bond after his mixed verdict. At the time, Combs agreed to surrender his passport, limit his travel strictly to California, Florida, New York, and New Jersey, and also subject himself to drug testing. Despite this, Judge Subramanian denied the request, citing Combs' history of intimate partner violence, particularly toward his ex-girlfriend, Cassie.

The judge emphasized that "this type of violence, which happens behind closed doors in personal relationships, sparked by unpredictable bouts of anger, is impossible to police with these conditions."

Prosecutors’ Response and Trial Allegations

Prosecutors have yet to respond to the new $50 million bond request. In Diddy’s team’s new motion, the embattled rapper has again agreed to give up his passport due to concerns about him being a flight risk. He also intends to limit his travel strictly to the Southern Districts of Florida and New York, solely for legal consultations.

According to reports, Judge Subramanian has given federal prosecutors until Thursday, July 31, to file their response to the request.

During the eight-week trial, federal prosecutors argued that Diddy was the head of a criminal enterprise involved in crimes such as kidnapping, bribery, and arson. They further alleged that he forced his former partners, Cassie and another woman referred to as "Jane," to engage in sex acts with male escorts. Both women testified in court, detailing their experiences.

One key piece of evidence presented to the jury was a 2016 hotel surveillance video showing Diddy physically assaulting Cassie. At Diddy’s bail hearing, prosecutors strongly opposed his release. They emphasized a violent incident with Jane in June 2024, which occurred even after federal agents had raided Diddy’s homes and while he was fully aware that he was under investigation for sex trafficking.

"The only things exceptional about this defendant are his wealth, his violence, and his brazenness," lead prosecutor Maurene Comey told the judge during the July 2 hearing.

Ongoing Legal Proceedings

As Diddy awaits his sentencing, the rapper has reportedly been engaging in therapy while behind bars. His legal team continues to fight for his release, emphasizing the lack of precedent for applying the Mann Act in cases involving personal relationships rather than commercial enterprises. The outcome of the latest bond request will be critical in determining whether Diddy remains in custody or is released pending his sentencing.
